For every kilometer each participant runs, Grupo Bimbo will donate two slices of bread to those who need it the most.

BIMBO® 2017 Global Energy Race Donation Program

TERMS AND CONDITIONS

By participating in the BIMBO® 2017 Global Energy Race Donation Program (the “Program”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

Eligibility: Program is open to legal residents of the United States and the District of Columbia who are 13 years of age or older (excluding residents of the states of Alabama, Hawaii, Illinois, Massachusetts, Mississippi and South Carolina). Eligible minors must obtain their parents’ or legal guardians’ consent prior to participating. Void in the states of Alabama, Hawaii, Illinois, Massachusetts, Mississippi, South Carolina and where prohibited by law. All applicable federal, state and local laws and regulations apply.

Program Period: Program starts at 12:00am Pacific Time (“PT”) on June 7, 2017 and ends at 7:30am PT on September 24, 2017, or when the maximum donation (described below) has been reached, whichever is sooner (“Program Period”). The Program Period will be divided into five (5) race locations, as further outlined in the chart below (each, a “Race Location”).

How to Participate: During the Program Period, visit the Global Energy 2017 website at www.globalenergyrace.com and follow the directions provided to complete the registration form for one (1) of the Global Energy 5k or 10k races (each, a “Race”) at any of the five (5) Race Locations and submit the form to register for the applicable Race. Bimbo Bakeries USA, Inc. (“BBU”) will donate ten (10) slices of bread for each eligible 5k Race registration and twenty (20) slices of bread for each eligible 10k Race registration throughout the Program Period, with a maximum donation of 250,000 slices of bread donated. Of the 250,000 slice maximum donation, a minimum of 40,000 slices will be donated to each of the following five (5) food banks; (i) St. Mary's Food Bank Alliance; (ii) Los Angeles Regional Food Bank; (iii) Second Harvest Food Bank of Central Florida; (iv) Philabundance; and (v) North Texas Food Bank. Limit of one (1) Race registration per person. You may only use one (1) email address to register for a Race. Information about St. Mary's Food Bank Alliance, Los Angeles Regional Food Bank, Second Harvest Food Bank of Central Florida, Philabundance, and North Texas Food Bank including their financial, licensing or charitable purpose may be obtained, without cost, by visiting their respective websites at www.firstfoodbank.org/, www.lafoodbank.org/, www.feedhopenow.org, www.philabundance.org/, and www.ntfb.org. Donation will be made to the applicable food banks within sixty (60) days following the conclusion of the Program Period.

Important Note to AL, HI, IL, MA, MS & SC Residents: As mentioned above, residents of the states of Alabama, Hawaii, Illinois, Massachusetts, Mississippi and South Carolina are encouraged to register for an eligible Race, however, their participation/registration in an eligible Race will not affect the amount of bread slices being donated.

General Restrictions: BBU reserves the right to cancel, suspend or modify any part of this entire Program at any time without notice, for any reason in its sole discretion. BBU’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that or any other provision. BBU reserves the right to disqualify participants who violate these Terms and Conditions or interfere with this Program in any manner and void all associated registrations. Should any portion of the Program be, in BBU’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the BBU, corrupt or impair the administration, security or fairness of the Program, BBU reserves the right at its sole discretion to suspend, modify or terminate the Program and, if suspended, resume the Program in a manner that best conforms to these Terms and Conditions. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ION RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

General Conditions: By participating in this Program you agree to (i) be bound by these Terms and Conditions (ii) release and hold harmless BBU, St. Mary's Food Bank Alliance, Los Angeles Regional Food Bank, Second Harvest Food Bank of Central Florida, Philabundance, North Texas Food Bank and their respective parent, subsidiary and affiliated companies, retailers, distributors, licensees, manufacturers, web design, advertising, fulfillment and promotion agencies and their respective employees, officers, directors and shareholders (collectively, “Released Parties”) from any claims, actions, injury, loss or damage of any kind resulting from participating in this Program. Released Parties are not responsible for lost, late, misdirected, inaccurate, incomplete, delayed or garbled Race registrations, or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or for any other errors or problems of any kind, whether typographical, printing, mechanical, human, electronic or otherwise, relating to or in connection with the Program, including, without limitation, any error or problem which may occur in connection with the administration of the Program or the processing of Race registrations. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Program. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Program or downloading materials from or use of the website.
